These terms and conditions (T&C's) of online sale apply exclusively to distance selling via the website of products duly described and illustrated on the website www.labetise.fr (hereinafter the "Product(s)"). In the event of a modification to the general terms and conditions of online sale, those published on the website (hereinafter the "Site") at the time the order proposal is sent (hereinafter the "Order Proposal") shall apply to the purchase made by the buyer of the Products (hereinafter the "Client"). Any previous version of the general terms and conditions of online sale can be accessed in the appropriate section of the Site, which will be available for saving and printing.
The Client is requested to read and accept these T&C's of online sale before submitting their Order Proposal. Sending the Order Proposal implies full knowledge and explicit acceptance of both these T&C's of online sale and the Order Proposal itself.
The seller of the Products (hereinafter the "Seller") is DARKSOULS FRANCE, a company governed by French law, a single-shareholder simplified joint-stock company (Société par Actions Simplifiée unipersonnelle), having its registered office at Île de France, 93200 Saint-Denis, registered with the Paris Trade and Companies Register (Registre du Commerce et des Sociétés de PARIS) under number 100 068 188, and with intra-community VAT number FR52100068188.
These general terms and conditions of online sale govern the purchase of products on www.labetise.fr (hereinafter the "Site"). However, they do not regulate the sale of products or services by third parties other than the Seller, who may be present on the Site via links, banners, or other hypertext links. The Seller is not responsible for the provision of goods and services by third parties.
The Client will be identified using the data provided in the Order Proposal. It is strictly prohibited to provide false and/or fictional data; the Seller is released from all liability in this regard.
Product offers on the Site are intended for adult clients. By placing an order on the Site, the Client guarantees that they are of legal age (18 years old) and possess the full legal capacity to enter into this type of contract.
2.1. Product Characteristics
The Products offered for sale are described and presented on the Site with the greatest possible accuracy. The information provided on the Product sheets details, in particular, their essential characteristics (colors, description, composition, care instructions, dimensions) and their price including VAT (VAT Included).
However, DARKSOULS draws the Client's attention to the fact that photographs cannot ensure perfect similarity with the Product offered for sale, particularly regarding colors.
Such differences may result, without limitation, from the quality of the photographs, the difficulty of accurately rendering materials on a screen, or technical adaptations. These differences shall not be interpreted as lack of conformity and shall not result in the cancellation of the sale.
In the event of an obvious error or non-significant omission between the characteristics of the Product and its representation and/or description, DARKSOULS shall not be held liable.
2.2. Product Availability
Products under the La Bêtise brand are offered for sale by DARKSOULS subject to availability. Only Products appearing on the Site on the day it is consulted by the Client are offered for sale. Thus, when placing an order, the Client is informed of the availability of the selected Product.
In the event that a Product is unavailable, DARKSOULS, via La Bêtise, undertakes to inform the Client as soon as possible by email. The company will also remain available to each Client for any questions regarding the availability of Products offered for sale on the Site.
In the case of payment by Credit/Debit Card, the total amount of the order will be debited. If it transpires that an ordered Product is no longer available after payment has been processed, DARKSOULS will issue a refund for the amount of the corresponding unavailable Product using the same payment method. In the event of an immediate payment via PayPal, the price of the Product that turns out to be
unavailable will be refunded directly to the said account.
In the case of payment by Gift Card, the price of the Product will be refunded via an e-gift card. This will be sent by email to the email address used when placing the La Bêtise order.
In the event of a Product's unavailability, La Bêtise may communicate the estimated waiting time for its delivery.
The Client may then either confirm their order or request a refund for the Product based on the invoiced price.
Shipping fees will be refunded to the Client only if they confirm the cancellation of their entire order. Shipping fees will remain at the Client's expense if they confirm the delivery of one or more other available Products belonging to the same order.
2.3. Purchase Limits
The Site does not permit the purchase of Products for resale. In this regard, the Client's attention is particularly drawn to the fact that their Orders must not exceed ten (10) items per order, nor display an abnormal character or a total amount exceeding one thousand (1,000) euros. Clients wishing to make a purchase for a total sum exceeding the said amount, and for purposes other than resale, are invited to contact La Bêtise Customer Service to inquire about the feasibility and purchase conditions on the Site.
Product prices are indicated in Euros, inclusive of all taxes (excluding shipping fees), and include the
VAT applicable on the date the order is placed. Any change in the VAT rate will be automatically reflected in the price of the Products.
The flat-rate contribution toward shipping fees is disclosed to the Client in the order summary prior to validation.
La Bêtise reserves the right to modify the prices and descriptions of the Products at any time in the event of an increase in costs, notably the VAT rate, or in the case of an obvious typographical or data entry error.
However, Products will be invoiced based on the rates in effect at the time the order is registered, except in the event of an obvious error.
Indeed, despite the vigilance of La Bêtise, pricing errors may occur on the Site for any reason whatsoever (computer bug, manual error, technical error, etc.). If orders are placed at incorrect or obviously derisory prices (trifling prices), they will be cancelled, even if they were initially validated by La Bêtise. The company will inform each affected Client as soon as possible so that they may, if they wish, re-place their order at the corrected and correct price.
Placing an order implies acceptance of the prices and descriptions of the Products available for sale. Any dispute regarding this point will be handled within the scope of a potential "refund," as detailed below in Article 7.
The Client acknowledges and accepts that Product prices are subject to variation between the Site and physical stores and that, under no circumstances, shall this difference in price justify a request for either a full or partial refund (outside of the right of withdrawal applicable under the Conditions provided hereinafter).
When an order benefits from a discount or a promotion that reduces the total amount payable, the amount of this discount will be applied proportionally (pro-rata) to the initial price of each Product in the order that qualified for the said promotion.
Consequently, in the event of a return or refund, the amount returned will correspond to the price actually paid for the Product(s) after the application of the pro-rated discount, as stated on the invoice received by the Client.
4.1. Account Creation / Client Number
To place an order, the Client can:

If they already have an account: enter their email address and password (which are strictly confidential and personal) to log in to the Site.

If they do not have an account: check out as a "guest" or create an account by filling in the required fields to obtain their personal login credentials. Any loss or forgotten credentials must be reported to La Bêtise as soon as possible by contacting Customer Service.
Whether holding an account or not, the Client must enter all personal data marked with an asterisk, which is mandatory and necessary for invoice processing and order delivery.
It is important that the Client fills out the form accurately to avoid any errors or issues affecting the shipment of the ordered Product(s). The data recorded on this Site is exclusively intended for La Bêtise or its partners, subject to the Client's express acceptance under the Terms specified below.
La Bêtise reserves the right not to process orders that do not provide sufficient guarantees of solvency, orders that are incomplete or incorrect, or in the event of Product unavailability. In such cases, no later than thirty (30) business days from the date the order was sent by the Client, the Client will be informed by email of the reasons why the order cannot be executed, and no Order Proposal will be accepted. Any amount actually paid will then be refunded to the Client.
4.2. Order Registration
Any client wishing to place an order selects the Product(s) of their choice by clicking "Add to Cart".
At the end of this step, and after clicking "Checkout", a dedicated delivery page will be displayed, where the Client must enter their postal address and select their chosen delivery method. A summary page of the order form will then appear on the screen, allowing the Client to make any necessary modifications before proceeding to payment.
By validating their order, the Client acknowledges that they have read the General Terms and Conditions of Sale in effect on the date of the said order and accept them without reservation.
Any order placed on the Site, whether personally or via a tablet, and duly validated by the Client, can no longer be cancelled. The Client must wait for its receipt and apply their right of withdrawal (see Article 6.1).
4.3. Order Validation and Payment
The purchasing Client guarantees to La Bêtise that they possess the necessary authorizations to use the payment method selected during order registration.
By validating their Shopping Cart, the summary order form, and the General Terms and Conditions of Sale, the Client accesses the payment stage. The price owed by the Client is the amount indicated on the summary order form previously validated by the Client. This validation constitutes express acceptance of all transactions carried out on the Site.
Any order placed on the Site must be paid for exclusively online using one of the following credit/debit cards: Visa, Mastercard, American Express, e-carte bleue (or any of their variations), via PayPal, and/or a La Bêtise Gift Card.
For Credit/Debit Cards, the order is only processed after entering the card number, its expiration date, and the card verification code (the 3-digit security code on the back of the card) required for payment. The payment is subject to final validation by the GIE carte bancaire.
In all cases, providing the card number online and the final validation of the order shall constitute proof of the entire order, in accordance with the provisions of the Law of March 13, 2000, and shall make the sums incurred for the Products listed on the order form due and payable.
The card is debited at the moment the order is validated. In the event of a stock shortage after order validation, the amount of the cancelled item(s) will be refunded directly to the Client's account.

Via Apple Pay: Payments through the application are only possible for orders placed from an authorized Apple device.

PayPal Account: By choosing this payment method, the Client will be redirected to their PayPal account (or can create one) to complete their purchase quickly and securely.

La Bêtise Gift Card: For payments using a physical Gift Card, the Client must enter the 19 digits and the PIN code revealed after scratching the dedicated area. For an e-gift card, the Client
Upon order validation, the Client will receive an Order and Shipment Confirmation by email containing: a reference to these online Terms, already read and accepted by the Client when submitting the Order Proposal, along with an order summary.
La Bêtise reserves the right to request additional information regarding the order by email or telephone before sending the Order and Shipment Confirmation.
4.4. Secure Payment
La Bêtise uses the secure payment service STRIPE, which integrates the SSL security standard. Confidential data (card number, expiration date) is transmitted encrypted directly to the STRIPE server and is never stored on La Bêtise's servers.
The STRIPE server is directly connected to the banking servers of each country involved.
Subject to receiving the Client's express consent, La Bêtise may save/memorize credit/debit card details so that the Client does not have to re-enter them for every order. The security code on the back of the card will not be stored. This data will be retained until the Client expressly withdraws their consent or until the card expires.
By accepting these General Terms and Conditions of Sale, the Client accepts the terms and formalities related to the prevention of payment fraud described below.
Information regarding the order placed online by the Client on the Site is subject to automated data processing managed by STRIPE (CNIL authorization No. 1364484), with whom La Bêtise (through DARKSOULS) has entered into an agreement for this purpose.
The sole purpose of this automated personal data processing is to analyze the transaction level and combat payment fraud.
To this end, STRIPE may request the Client to provide supporting documents (regarding identity, billing or delivery address, the payment method used, etc.). Failure or refusal by the Client to provide the requested documents may lead La Bêtise to decline the order. The time taken to transmit the requested supporting documents may delay the shipment and delivery of the ordered Products accordingly.
STRIPE, DARKSOULS, and any third-party service providers occasionally involved in order management are the sole recipients of data related to the Client's order. The occurrence of an unpaid balance solely due to the fraudulent use of a credit card will automatically result in the registration of the order details within a database managed by STRIPE.
In the event of fraudulent use of their credit card, the Client is invited, as soon as this use is noticed, to contact their bank, law enforcement authorities, and, if applicable, file an official complaint.
La Bêtise is not authorized to disclose information to the Client upon simple request. It may only do so upon receipt of a judicial request issued by competent legal authorities.
4.6. Order Acknowledgment of Receipt
The final validation of the order takes place after the payment is approved.
A confirmation email containing the order details and the total amount will be sent to the Client to confirm registration, featuring a summary of all the information previously provided.
The sale will only be considered final after the selected payment method is approved and the full price is collected by La Bêtise, subject to Product availability.
4.7. Order Tracking
Details and shipping tracking for each order can be viewed at any time on the Site under the "My Account" section, after the Client logs in with their email and password.
If the Client did not create a specific account, they can access their order tracking via the link included in their order confirmation email, or via the guest delivery tracking option available on the website www.labetise.fr.
In all cases, the Client will be kept informed of their order's transit status by email.
La Bêtise has partnered with two service providers for the delivery of its clients' purchases: Mondial Relay and Chronopost. We ensure that we offer our clients the best delivery rates as well as wider delivery coverage through these two providers.
The Client is hereby informed that, depending on Product availability locations and delivery time optimization, their order may be delivered in multiple shipments.
Except in cases of force majeure or unpredictable and insurmountable events, delivery times will be those indicated below and shall run from the date of order confirmation. They are communicated to the Client before any order validation and payment. It is therefore the Client's responsibility to select the delivery country and shipping method when prompted.
La Bêtise takes every precaution to ensure that packages arrive in perfect condition. Nevertheless, the Client is required to check the condition of the packaging and the conformity of the delivered Product, and, if necessary, to note any specific reservations on the carrier's delivery note or upon collecting the package from a Chronopost Pick-up point or Mondial Relay location.
5.1. Delivery Methods
Packages are delivered according to the Client's choice to the following countries: France (mainland), Spain, Belgium, Germany, and Italy.

Standard Home Delivery: Via Chronopost or Mondial Relay to the Client's home or any other address of their choice (to be specified in the delivery form after payment confirmation), provided it is located within La Bêtise's sales regions. Delivered without signature within 3 to 5 business days.

Please note: Home delivery is exclusively available for Mainland France. Only Pickup Point delivery is available for countries outside of France.

Chronopost Pickup Point (Relais Pick-up): The package is held for seven (7) business days at the selected pickup location. The Client will be notified by email or SMS upon the package's arrival at the pickup point. For any questions regarding your Pickup Point delivery, please contact Chronopost Pick-up Customer Service at 0969.391.391 from 8:00 AM to 7:00 PM, Monday to Friday, and Saturday from 8:00 AM to 12:00 PM (Chronopost Website).

Chronopost Express Home Delivery: Delivered to the Client's home or any other address of their choice within 1 to 3 business days (Exclusively available within Mainland France).
La Bêtise processes packages from Monday to Friday. Generally, all orders are processed within 2 to 3 business days. Additional transit times are determined by our transport partners. Typically, these do not exceed seven (7) business days for Mainland France. Please note: Processing times may be extended during periods of high commercial activity.
Home Delivery Terms: The package will be delivered to the address indicated by the Client when placing the order. If the Client is absent, the package may be:

Deposited directly into the mailbox;
-
Handed over to any other person present at the Client's address;
-
Delivered to a neighbor, building warden, or concierge who agrees to accept it;
-
Held at the post office nearest to the Client's delivery address for fifteen (15) days.
To locate their package, the Client must check the emails received from the postal services, using the tracking number provided to them by email.
5.2. Delivery Zones
Delivery is available to the following countries: Mainland France, Spain, Italy, Germany, and Belgium.
5.3. Delivery Terms and Delays
All deliveries are completed within a maximum period of 7 business days following the order date. In the event that the delivery deadline is exceeded (except in cases of force majeure) and within a maximum period of sixty (60) days from that same date, the Client may report the delay by visiting the "Need Help?" section on the Site.
Upon notification, La Bêtise will contact the appropriate services to conduct an investigation, which will not exceed thirty (30) days.

If the package is not located by the end of the investigation, the Client will be refunded the full amount of their order.

If the package is located before the 30-day deadline, La Bêtise will inform the Client. The Client will then have the option to either have the package delivered to the address specified at checkout or refuse it due to the delivery delay and request a full refund.

If the package is officially confirmed lost, La Bêtise will refund the Client the sums paid at the time of the order.
Any refund will be issued within a maximum of fourteen (14) days from the confirmation of the lost package or the notification of order cancellation. The Client's bank account will be re-credited with the amount of the undelivered or returned items via the STRIPE secure payment system.
Should the Client receive the package after their order has been refunded, they agree to immediately inform Customer Service and return it in accordance with the provided instructions.
Missing Package Procedures:

For any misplaced or undelivered package, La Bêtise will conduct an investigation to determine whether a refund is warranted based on the findings. A completed CERFA statement (No. 11527*02) may be requested.

For all orders under one hundred and twenty euros (€120) that fail to reach their destination, the Client must return a duly completed CERFA form (No. 11527*02) or a non-receipt declaration to Customer Service.

For all orders under one hundred euros (€100) that fail to reach their destination despite delivery confirmation from the carrier, the Client must contact Customer Service so that an internal investigation can be launched with the carrier. Depending on the investigation's outcome, a CERFA document will be required. If the order exceeds one hundred euros (€100), filing an official police complaint will also be suggested to facilitate a judicial investigation.

The Client may be required to provide La Bêtise with proof of identity upon request.
Due to an increase in fraudulent non-delivery claims, La Bêtise reserves the right to review order history and client data. In the event of an anomaly or legitimate suspicion of deception by a Client (recurring claims, use of multiple accounts, falsification of return labels, etc.), La Bêtise reserves the right to:

Refuse to issue a refund.

Require the Client to use a secured delivery method for future orders to prevent disputes. Should the Client refuse, La Bêtise remains free to decline any new orders from that client.

In cases of repeat offenses or proven bad faith, purely and simply terminate the Client's account and refuse any future transactions.
5.4. Delivery Fees
Flat-rate delivery fees depend on the Client's delivery country. They are accessible when placing the order and will be detailed on the order summary page based on the selected shipping method.

Free Delivery: If the total order amount exceeds €50.00 (Fifty Euros), standard delivery fees will be free of charge. Flat-rate delivery fees are explicitly indicated on the order summary page.
6.1. the Right of Withdrawal
La Bêtise allows the Client a maximum period of fourteen (14) days from the date of receipt of their order to exercise their right of withdrawal. The Client may exercise this right without having to provide any reasons or incur any costs other than those necessary for returning the order.
The Client is required to submit an unambiguous return declaration expressing their intent to withdraw, directly from their client account on the Site. Products must be unworn, unwashed, and returned in their original packaging with all labels intact, accompanied by the invoice.
Please note that La Bêtise will not accept or offer refunds for returned Products that are incomplete, damaged, altered, or soiled by the Client.
6.2. Return Methods
The Client must send back the Products affected by the return—under the conditions detailed in Article 7 below—within fourteen (14) days following the communication of their decision to withdraw, as defined in Article 6.1 above.
7.1. Returns
Clients shall have the opportunity to change their mind up to fourteen (14) days after the date of receipt of their order for any Product, provided it is unworn and in its original packaging. The relevant Product must be accompanied by its original label and the invoice. The invoice is available on the Site under the "My Account" section and must be printed and completed by the Client, or accessed via the order shipment email if the Client does not have an account.
When an order benefits from a discount or a promotion that reduces the total amount payable, the amount of this discount will be applied proportionally (pro-rata) to each Product in the said order based on its initial price. Consequently, in the event of a return or refund, the amount returned will correspond to the price actually paid for the item after the application of the pro-rated discount.
7.2. Refunds
La Bêtise will refund the Client the sums paid for the Products (only in the event of a full return of the entire order); this excludes any shipping fees (€6.00 VAT included) that the Client may have incurred. The refund will be processed within a maximum period of fourteen (14) days following the receipt and logging of the Products at the warehouse.
The refund will be issued using the same payment method that was used for the purchase.
The Client's bank or PayPal account will be credited directly for the amount of the returned Products via our secure payment partner, STRIPE.
In the event of a partial or full payment made by Gift Card, the refund for the corresponding amount will be issued via an e-gift card. This will be sent by email to the address provided on the La Bêtise order.
As specified in Article 3 above, where a discount has been applied to all or part of an order, any returned or refunded Product that qualified for the said discount will be refunded at the price of the Product minus the pro-rated discount, as stated on the invoice.
For any questions regarding an order, La Bêtise Customer Service is available to its Clients via the "FAQ" section. In the event of a dispute, the Client must provide their order number as well as the exact reason for their request. Following the resolution of a dispute, if a refund is required, it will be processed directly through the payment method used when placing the initial order.

After each visit to the Site, the Client should remember to log out of their profile to ensure the continued confidentiality of their data.
The Products offered for sale comply with current French legislation. All Products benefit from the legal regime of the warranty of conformity provided for in Articles L217-4 et seq. of the French Consumer Code, as well as the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.
Article L217-4 of the French Consumer Code
The goods conform to the contract if they meet, in particular, where applicable, the following criteria:

They correspond to the description, type, quantity, and quality, particularly regarding functionality, compatibility, interoperability, or any other characteristic provided for in the contract;
-
They are fit for any special purpose sought by the consumer, made known to the seller at the latest at the time of the conclusion of the contract, and which the latter has accepted;
-
They are delivered with all accessories and installation instructions, which must be provided in accordance with the contract;
-
They are updated in accordance with the contract.
Article L217-5
I.- In addition to the contract conformity criteria, the goods conform if they meet the following criteria:
-
They are fit for the purpose usually expected of goods of the same type, taking into account, where applicable, any provision of European Union law and national law as well as all technical standards or, in the absence of such technical standards, specific codes of conduct applicable to the sector concerned;
-
Where applicable, they possess the qualities that the seller presented to the consumer in the form of a sample or model before the conclusion of the contract;
-
Where applicable, the digital elements they contain are provided according to the most recent version available at the time of the conclusion of the contract, unless the parties agree otherwise;
-
Where applicable, they are delivered with all accessories, including packaging, and installation instructions that the consumer can legitimately expect;
-
Where applicable, they are provided with the updates that the consumer can legitimately expect, in accordance with the provisions of Article L. 217-19;
-
They correspond to the quantity, quality, and other characteristics, including in terms of durability, functionality, compatibility, and safety, that the consumer can legitimately expect for goods of the same type, having regard to the nature of the goods as well as public statements made by the seller, by any person upstream in the transaction chain, or by a person acting on their behalf, including in advertising or on labeling.
II.- However, the seller is not bound by any public statements mentioned in the preceding paragraph if they demonstrate:

That they did not know them and were legitimately not in a position to know them;

That at the time of the conclusion of the contract, the public statements had been corrected in conditions comparable to the initial statements; or
-
That the public statements could not have influenced the purchasing decision.
III.- The consumer cannot dispute conformity by invoking a defect concerning one or more specific characteristics of the goods, of which they were specifically informed that they deviated from the conformity criteria set forth in this Article, a deviation to which they expressly and separately consented at the time of the conclusion of the contract.
Article L217-7
Any lack of conformity appearing within a period of twenty-four months (note: please verify if your original text stating "trois mois" was an intentional restriction, as French law dictates 24 months) from the delivery of the goods, including goods containing digital elements, is presumed to exist at the time of delivery, unless proven otherwise, or unless this presumption is incompatible with the nature of the goods or the nature of the defect invoked.
Article L217-9
The consumer is entitled to demand that the goods be brought into conformity with the criteria set forth in Subsection 1 of this Section.
The consumer requests the seller to bring the goods into conformity, choosing between repair and replacement. To this end, the consumer makes the goods available to the seller.
Article L217-10
Bringing the goods into conformity shall take place within a reasonable timeframe, which may not exceed thirty days following the consumer's request, and without major inconvenience to them, taking into account the nature of the goods and the purpose sought by the consumer.
The repair or replacement of the non-conforming goods includes, where applicable, the removal and return of the goods and the installation of the repaired or replacement goods by the seller.
Article L217-11
Bringing the goods into conformity shall be carried out at no cost to the consumer.
The consumer is not required to pay for the normal use they made of the replaced goods during the period prior to their replacement.
Article L217-12
The seller may choose not to proceed according to the choice made by the consumer if the requested compliance is impossible or entails disproportionate costs, particularly with regard to:

The value the goods would have in the absence of the lack of conformity;
-
The significance of the lack of conformity; and
-
The possibility of opting for the alternative choice without major inconvenience to the consumer.
The seller may refuse to bring the goods into conformity if it is impossible or entails disproportionate costs, particularly with regard to items 1 and 2 above.
When these conditions are not met, the consumer may, after giving formal notice, pursue forced execution in kind of the solution initially requested, in accordance with Articles 1221 and seq. of the French Civil Code.
Any refusal by the seller to proceed according to the consumer's choice or to bring the goods into conformity shall be justified in writing or on a durable medium.
Article L217-13
Any goods repaired under the legal warranty of conformity benefit from a three-month extension of this warranty.
If the consumer chooses repair but it is not implemented by the seller, bringing the goods into conformity by replacement triggers a new legal warranty period of conformity attached to the replaced goods for the benefit of the consumer. This provision applies from the day the replacement goods are delivered to the consumer.
Article L217-14
The consumer is entitled to a reduction in the price of the goods or to the rescission of the contract in the following cases:

When the professional refuses any compliance;
-
When the compliance occurs beyond a period of thirty days following the consumer's request, or if it causes them a major inconvenience;

If the consumer definitively bears the costs of return or removal of the non-conforming goods, or if they bear the installation of the repaired or replacement goods or the associated costs;

When the non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to the rescission of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. The consumer is then not required to request the repair or replacement of the goods beforehand.
The consumer is not entitled to the rescission of the sale if the lack of conformity is minor, which it is up to the seller to prove. This paragraph is not applicable to contracts in which the consumer does not pay a price.
Article L217-15
In the cases provided for in Article L. 217-14, the consumer informs the seller of their decision to obtain a reduction in the price of the goods.
The price reduction is proportional to the difference between the value of the delivered goods and the value of these goods in the absence of the lack of conformity.
Article L217-16
In the cases provided for in Article L. 217-14, the consumer informs the seller of their decision to rescind the contract. They return the goods to the seller at the latter's expense. The seller refunds the price paid to the consumer and returns any other benefit received under the contract.
If the lack of conformity only covers certain goods delivered under the sales contract, the consumer has the right to rescind the contract for all the goods, even those not covered by this Chapter, if they cannot reasonably be expected to agree to keep only the conforming goods.
Article 1641 of the French Civil Code
The seller is bound by the warranty on account of hidden defects in the item sold which render it unfit for the use for which it is intended, or which so impair this use that the buyer would not have acquired it, or would only have given a lesser price, had they known of them.
Article 1642
The seller is not liable for apparent defects of which the buyer was able to convince themselves.
Article 1643
The seller is liable for hidden defects, even if they were not aware of them, unless, in this case, they have stipulated that they will not be bound by any warranty.
Article 1644
In the cases of Articles 1641 and 1643, the buyer has the choice to return the item and have the price refunded, or to keep the item and have a part of the price returned.
Article 1645
If the seller was aware of the defects of the item, they are bound, in addition to the restitution of the price received, for all damages and interests towards the buyer.
Article 1646
If the seller was unaware of the defects of the item, they shall only be bound to restitute the price and to reimburse the buyer for the expenses occasioned by the sale.
Article 1647
If the item which had defects has perished as a result of its bad quality, the loss is for the seller, who will be bound towards the buyer for the restitution of the price and other compensations explained in the two preceding articles.
However, a loss occurring by a fortuitous event will be on the buyer's account.
Article 1648
The action resulting from redhibitory defects must be brought by the buyer within a period of two years from the discovery of the defect.
Despite the care taken in managing our Site, the photographs and texts reproduced to illustrate the displayed Products may occasionally contain errors. In the event of receiving a Product that does not conform to the one viewed on the Site, the Client may request a refund in accordance with Article 7 of these General Terms and Conditions of Sale.
La Bêtise shall not be held liable for the non-performance of the contract concluded in the event of:

Finally, La Bêtise declines all liability for:

In view of potential developments on the Site, La Bêtise reserves the right to adapt or modify these T&Cs of Sale at any time.
Any new T&Cs of Sale will, where applicable, be brought to the Client's attention via an online update and shall apply exclusively to sales made subsequent to the said modification. La Bêtise invites its clients to consult them regularly.
