When using our Platform, La Bêtise may process personal data concerning you that you have provided to us or that we have collected during your interaction(s) with us.
As soon as you use our Platform, you are subject to the Policy currently in effect and signify your acceptance of it. Since we may modify our Policy at any time in accordance with the conditions set forth in Article 6, we invite you to check it before each use of our Platform.

In accordance with applicable regulations, you possess various rights regarding your personal data. Once your request is received, we undertake to process and respond to it diligently within a maximum of 30 days. In the event of doubt regarding your identity, we may request a copy of your identity document or other proof. The rights you benefit from are the following:
The Right of Access: The right to request a copy of the personal data we hold about you. If your request is unfounded or excessive, we may charge you a fee related to this request.
The Right to Modify: The right to request the correction of inaccurate personal data we hold about you. If you have a customer account, you can access the section corresponding to your personal data to modify or update it. You must ensure that this data is true and accurate. Likewise, you undertake to notify us of any change or modification to this data. We also remind you that, in principle, you must only provide your own personal data and not that of a third party. Any damage or loss caused as a result of providing inaccurate or incomplete information in our data collection forms remains the exclusive responsibility of the user of our Platform.
The Right to Delete (Right to be Forgotten): The right to request the deletion of your data, provided one of the following conditions is met:

your personal data is no longer necessary in relation to the purposes for which it was collected,

you withdraw your consent and there is no other legal basis justifying the continued processing of your personal data,

you validly exercise your right to object,

Nevertheless, there are cases where you cannot exercise your right to erasure, even if one of the aforementioned conditions is met (compliance with a legal obligation, the establishment, exercise, or defense of legal claims). To delete your La Bêtise account, you may do so directly from your account settings or by submitting your request either to services@labetise.fr or to Darksouls, Ile De France, 93200 Saint-Denis - France. We wish to inform you, however, that this deletion will automatically result in the loss of any points you may have accumulated through your membership in our loyalty program.
The Right to Object: The right to object, on grounds relating to your particular situation, at any time to the processing of your personal data based on our legitimate interest. In such event, we will cease processing your data unless we demonstrate compelling legitimate grounds to continue doing so. If your data is used for commercial prospecting (direct marketing) purposes, you have the right to object without having to provide any justification.
The Right to Restriction of Processing: The right to request the temporary freezing of the use of all or part of your data while a request for rectification, objection, or erasure is being examined. During this period, we will no longer use this data but must retain it.
The Right to Data Portability: If the processing of your personal data is based on your consent or the performance of a contract, and if the processing is carried out by automated means, you have the right to receive the data concerning you in a structured, commonly used, and machine-readable format, in order to transmit it to another entity, provided that this is technically feasible.
The right to define directives regarding the disposition of your personal data after your death.

4.1. Purposes and Legal Bases for Data Collection

Why do we process your data?
To process, fulfill, and track your product orders placed on the La Bêtise Site and mobile application.
Purposes
You can place your orders using your La Bêtise account on the Site or its mobile version. If you do not wish to create an account, you can place your orders on the Site as a guest. For the proper performance of the purchase contract concluded between us, we process your data to manage payments for the products you purchase and to issue the related invoices. We also process your data to successfully fulfill the delivery of your products and to manage any potential post-purchase returns.
Legal Basis: What is the justification for this processing?

Abandoned Cart: If you are a member of our loyalty program and have previously accepted its terms upon registration, as well as the placement and reading of cookies on the Site, we may send you an email offering to recover your uncompleted shopping cart within 3 hours, and subsequently within 24 hours, following the abandonment of your cart.

Membership in the loyalty program is created automatically when you set up a La Bêtise account, either online on the Site or via its mobile version. You provide the identification and contact data necessary to identify yourself and to grant you access to the various features, services, information, and products available to you. The processing of your data is therefore required for the performance of the general terms and conditions of our loyalty program.

If you wish, you may also save your phone number (to receive La Bêtise offers and updates via SMS, provided you have accepted them), your date of birth, as well as data relating to your preferences in your La Bêtise account, in order to personalize your experience with La Bêtise.

If you request the installation of your La Bêtise loyalty card in your mobile wallet (namely Apple Wallet or Google Pay), you authorize us to provide the relevant service providers with your identification data—first name, last name, and loyalty card number—as well as information regarding your La Bêtise product purchases.

If you have saved your date of birth in your La Bêtise account, we will send you an email informing you of the rewards and benefits you are entitled to. You will also be notified of the opening of private sales. We will inform you by email of updates to your points balance following a purchase, as well as a reminder before they expire.

You can unsubscribe from any or all of these communications at any time through your La Bêtise account or by contacting customer service. Furthermore, you can subscribe to La Bêtise newsletters on the Site without having a La Bêtise account, and unsubscribe by clicking the "unsubscribe" link at the bottom of each email. Regarding SMS communications, you can opt out of receiving further promotional text messages by replying "STOPLABETISE" to 36980.

Similarly, if you have downloaded your loyalty card to Apple Wallet or Google Pay, you can also receive La Bêtise notifications on your phone. You can opt out of Apple Wallet and Google Pay notifications at any time via your mobile phone settings.

If you accept the applicable general terms of use (notably those of the social networks you use), we may feature on our Platform or our various social media channels photographs that you have shared publicly or with us.

You can, however, object to this type of communication by contacting us via email at services@labetise.fr. You can also configure your advertising preferences directly within your user accounts on our partners' platforms.

If you have a La Bêtise account and have made at least one purchase while logged in, we have a legitimate interest in sharing your data with our third-party partners to identify users with a profile similar to yours in order to deliver La Bêtise advertisements to them. You can object to this processing by notifying us either by email at services@labetise.fr

Subject to obtaining your consent, your data—with the exception of the CVV/security code—may be kept longer to facilitate payment for subsequent purchases, without exceeding the duration necessary to achieve this purpose. In other words, your data may be retained until the withdrawal of your consent, the deletion of your loyalty account, and/or the expiration of your bank card.

Secondly, independently of the retention period necessary to achieve the purpose of data processing, it may be justified for us to archive your data for a limited period, in a secure manner and with restricted access, to:

Receiving Offers and News from La Bêtise Partners
Your email address may be transmitted to partners to receive their offers and news only if you have given your consent. You can withdraw your consent at any time directly in your account or by contacting Customer Service at services@labetise.fr.
In any case, there is no transfer outside Europe and La Bêtise does not transmit your personal data except:

Technical and organizational security measures have been established for this purpose.
However, La Bêtise does not control all risks associated with the operation of the Internet and draws the attention of internet users to the existence of potential risks inherent to its use and operation.
For the purposes of technical storage of your personal data, your data is centralized with the following service providers:

5.4. Your Choices Regarding Cookies
You can express your choices regarding whether or not to allow the placement of Cookies through our OneTrust consent management platform (CMP), which is displayed during your first visit.
